Definition Of Discrimination According To The Equality Act 2010 The Equality Act 2010 explicitly states that it is against the law to treat any person unfairly or less favourably than someone else because of a personal characteristic.

The Equality Act stipulates that direct discrimination occurs where a person treats less favourably another due to the latter’s protected characteristic. Thus, there must be a comparator to compare with. If one does not exist, the court would create an imaginary comparator.
